When Can You Claim Compensation?

Workers or their dependents can claim under the following circumstances:

  1. Injuries at Work: If you’re injured while performing duties within the scope of your employment.

  2. Occupational Diseases: When diagnosed with an illness directly caused by workplace conditions.

  3. Fatal Incidents: Dependents can claim if a worker dies as a result of a workplace injury or occupational disease.

Who Qualifies to Claim?

Most workers employed in South Africa are covered by the Compensation Fund. However, the following categories are excluded:

  • Domestic workers in private households.

  • Members of the South African National Defence Force (SANDF) and South African Police Service (SAPS) – they have their own compensation fund.

  • Workers employed outside South Africa for longer than 12 months unless there’s a special agreement with the Commissioner.

Employer Responsibility and Contribution to the Fund   

Employers are required to contribute to the Compensation Fund to ensure its sustainability. Workers are not required to contribute and should not have deductions made from their wages for this purpose.

Employers also have a duty to report workplace injuries or illnesses to the Compensation Commissioner within seven days for injuries or 14 days for occupational diseases. Failure to do so may result in penalties.

When is Compensation Not Paid?   

The Compensation Fund may reject claims under certain circumstances, including:

  • If the claim is submitted more than 12 months after the incident or diagnosis.

  • If the injury or illness resulted from the worker’s own misconduct unless it resulted in serious disability or death.

  • If the worker refuses necessary medical treatment.

Types of Compensation Available   

The Compensation Fund provides financial relief in the following forms:

  1. Temporary Disability: Payments for workers unable to work temporarily due to their injury or illness.

  2. Permanent Disability: Compensation for long-term injuries or illnesses that limit a worker’s ability to earn.

  3. Medical Expenses: Reimbursement for treatment related to workplace injuries or diseases.

  4. Death Benefits: Lump sums and pensions for dependents of workers who pass away due to workplace incidents.

Claiming Process   

The steps to claim from the Compensation Fund include:

  1. Reporting the incident to your employer immediately.

  2. The employer submits a formal report to the Compensation Commissioner.

  3. Visiting a medical professional for an evaluation and submitting required medical forms.

  4. Following up with the Commissioner for approval and processing of the claim.
