COSATU protest

COSATU has formally notified NEDLAC of its intention to embark on nationwide protest action on Tuesday, 7 October 2025. This is in line with Section 77 of the Labour Relations Act (LRA), which governs socio-economic protest action.

So, what does this mean for employers — and how should you prepare?

Background  

The reasons behind this year’s protest are the same ones raised in 2024. COSATU continues to campaign against what it calls “retrenchments to maximize profits,” a demand it has voiced since 2017. According to COSATU, South Africa has seen an increase in retrenchments alongside weak economic growth and rising living costs — issues they argue hurt working people the most.

Planned Activities  

The protest is set to run from 00h00 to 23h59 on Tuesday, 7 October 2025. COSATU has indicated that the action will include marches and pickets across major towns and cities. The scale of participation remains to be seen, but employers should anticipate possible disruption.

The Legal Framework  

Because this action is protected under Section 77 of the Labour Relations Act, employees who participate are legally protected from dismissal or disciplinary action for their involvement. However, employers still retain certain rights.

Guidance for Employers  

Here’s what you need to know:

  • Legal protection: Employees who take part in the protest are protected by law. The same applies to conduct in support of, or in anticipation of, the action.

  • No disciplinary action: You cannot discipline or dismiss employees for lawful participation, unless they are employed in essential or maintenance services, where restrictions apply.

  • No work, no pay: Employers may implement the “no work, no pay” rule. If employees are absent due to protest participation, you are not required to pay them for that period.

Final Thoughts  

While last year’s protest action saw relatively limited turnout, employers should still prepare for the possibility of higher participation this year — particularly in urban centres where marches are expected.
